Terms and Conditions
1. Scope of agreement
Please read these terms and conditions ( “Terms”) carefully before using https://www.syncycle.be/ operated by Endorphin SRL, registered in Belgium under the enterprise number: 1019.580.559, (“Syncycle,” “us”, “we”, or “our”), [our mobile applications (“Apps”),] services and products provided at our studios, and any other services that we provide that link to these Terms (the Site, Apps, and other services, collectively, the “Services”). These Terms is an agreement between you and Syncycle and sets forth the legally binding terms and conditions for your use of the Services. These Terms are binding on anyone who uses your account or credits. By accessing, purchasing or using the Services in any manner you agree to be bound by the Terms of Service. If you disagree with any part of the terms then you may not access the Service. 2. Studio policies
Age: By using the Services, you represent that you are over 16 years of age, and, if between the ages of 16 and 18, your parent or guardian has consented to these Terms and your use of the Services.
Credits: to book a class you must first own a single class or multiple classes. To buy a class or multiple classes online, you must sign up on this Site by using personal email and a password. Payment for all classes must be received prior to the scheduled class date to ensure your bike. All class packages are nominative non-transferable. A proof of identity can be requested by the staff at the studio reception.
Booking: Classes must be booked in advance. Classes are available for online booking from 2 weeks prior to class. “Book Class” allows you to book a class and “Add to Waitlist” allows you to put your name on the waiting list in case the class is fully booked. You agree that being on a waiting list for a session is like a commitment to joining that session. A notification is sent to you by email once you are confirmed.
Class access: You must be physically present 5 minutes prior to the start of your scheduled class or your bike may be given to a wait-listed client. If you are first timer you must be present at the studio no less than 15 minutes before the beginning of the class. No entry is permitted after the class has started. Anyone who accesses the Class agrees to be bound by these Terms.
Cancellations : If you need to cancel a class, make sure to do so at least 8 hours in advance to avoid a penalty. Any cancellation after this window will be considered late, and credit holders will lose their credit for the missed class. For unlimited memberships, a €5 cancellation fee will be applied if 3 late cancellations are registered within 30 days. No-shows will incur a €10 charge from the first occurrence. Cancellations must be made via the website or app—we do not accept cancellations by phone or email.
Personal belongings: You agree that we are in no way responsible for the safekeeping of your personal belongings while you are present in the studio. You assume all risk of loss for any of your personal belongings. Any locker not released at the end of the day will be opened by the Studio staff for safety and hygiene reasons Injury : If recovering from injury or illness, or have known sensitivities, notify the instructor prior to class start time.
Gift cards: they can be redeemed for classes or products. They cannot be redeemed for cash. Private events: event fees are due and payable at the time of booking and are non-refundable. All attendees must agree to these Terms prior to attending the event.
Services interruptions : Our Services, facilities may be suspended temporarily or permanently without notice to you for security purposes, maintenance or repairs, system failures, or other similar circumstances (collectively, “Service Interruptions”). You acknowledge and agree that you are not entitled to a refund or rebate related to such Service Interruptions. In case of cancellation of the class, your credit will be refunded.
3. Credits and fees
The prices are in euros (€) and include VAT. Credits have an expiration date stated on the pricing page on the Site. If you fail to pay fees or charges due, services or privileges may be suspended and/or terminated. You shall be liable for any external fees, including attorney fees and collection costs that Syncycle may incur in its efforts to collect any unpaid balances. You acknowledge that Syncycle's reserves the right to change its fees, offers and formula from time to time in its discretion. Special discount codes communicated on social media by our partners (or influencers) are valid for 30 days.
4. Refund policy
If you are a customer as defined by the Economic Law Code, you can cancel your online order for a class or online sales without giving any reason within 14 days from the day of the conclusion of the purchase to the extent you have not used the package purchased. You must inform us of your decision to cancel your order. You may submit your request by contacting us at [email]. To meet the cancellation deadline, it is sufficient for you to send your communication before the 14 days’ cancellation period has expired. The refund will be made within 14 days following the date we were informed of your decision, in the same means of payment that you used for the initial transaction. Without prejudice to the foregoing, classes are non-refundable. No exceptions (including injury, illness, change of address). Unused merchandise will be accepted for a store credit within 14 days of purchase. No returns will be provided without a receipt.
5. Intellectual Property Rights
The content on the Site and Apps, including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos interactive features and the like (“Content”) and the trademarks, service marks and logos contained therein (“Marks”), are owned by or licensed to Syncycle’s, subject to copyright and other intellectual property rights under the law. Content on the website is provided to you as is for your information and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. We reserve all rights not expressly granted in and to the website and the Content. You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information about the website or services, provided by you to Company are non-confidential and shall become the sole property of Syncycle’s. You agree to not engage in the use, copying, or distribution of any of the Content other than expressly permitted herein. You agree not to circumvent, disable or otherwise interfere with security-related features of the website or features that prevent or restrict use or copying of any Content or enforce limitations on use of the website or the Content therein. In participating in Syncycle's classes, you may be photographed or otherwise recorded by Syncycle or third parties authorized by Syncycle in its or such third parties producing of content which, among other things Syncycle or such third parties may use to advertise, report upon, market and/or promote Syncycle and its services. You hereby consent to such usage of imagery for all and any such purpose by Syncycle and such third parties and hereby agree that Syncycle and such third parties without any payment shall in all cases be the sole owner of all intellectual and other proprietary rights therein without any restriction whatsoever.
6. Personal Data and Data processing
You must ensure that the details provided by you on registration or at any time are correct and complete. You are responsible for maintaining the confidentiality of your account, password, and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account and/or password. The data you provide to Syncycle will be processed according to the Belgian Act of 8 December 1992 on the protection of privacy in relation to the processing of personal data and GDPR. The personal data we request which are marked with an * are mandatory in order to allow you to use of the Service. If you do not fill in these mandatory fields, we will not be able to process your request for an account or for use of the Service. The Syncycle's privacy policy, which can be consulted via this thinkfurther describes in detail how personally identifiable information may be collected, used and disclosed.
7. Assignment
You may not assign or transfer this agreement, Services, (or any of your rights or obligations under this agreement) without prior written consent of Syncycle. Any attempted assignment or transfer without complying with the foregoing will be void. We may freely assign or transfer this agreement. This agreement inures to the benefit of and is binding upon the parties and their respective legal representatives, successors, and assigns.
8. Limitation of Liability
By agreeing to this agreement, enrolling online, and/or attending classes, events, activities, and other programs of Syncycle, purchasing products, whether online or in a Syncycle’s facility or using Syncycle's equipment, and/or by using the Services, you hereby acknowledge and agree that (a) there are certain inherent risks and dangers in the strenuous nature of the Syncycle's workout program; (b) you have voluntarily chosen to participate in an intense physical exercise program; (c) you understand that Syncycle’s strongly recommends that you consult with a licensed physician prior to commencing any classes; (d) you have been fully informed of the strenuous nature of this exercise program and the possibility of adverse physiological occurrences; (e) you assume all risk for your health and well-being, and fully release and hold harmless for any responsibility, cost or damages the Syncycle’s, its instructors, members and employees for any injury, harm or loss you may suffer, as a result of participation in any Syncycle’s activities (f) ) you assume all risks related to COVID-19, and accept sole responsibility for any COVID-19-related injury, illness, damage, loss, claim, liability, or expense, of any kind (including, but not limited to, personal injury and disability) that may occur to you or your family members in connection with attendance at Syncycle’s or as a result of participation in Syncycle’s programs; and (g) you agree that neither you, your heirs, assigns or legal representatives will sue, Syncycle's its instructors, clients, and employees, from all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. You expressly agree that your use of the Service is at your own risk.
9. Changes to this agreement
We reserve the right to modify the Terms at any time, in our sole discretion. If we modify material terms to these Terms, such modification will be effective after we send you notice of the amended agreement. Such notice will be in our sole discretion, and the manner of the notification may include, for example, via email, posted notice on the Site or Apps, or other manner. Your failure to cease use of the Services after receiving notification of the modification will constitute your acceptance of the modified terms. It is your responsibility to check the Site regularly, for any modifications or updates to these Terms.
10. Notifications
We may provide notifications to you via email to the primary email address associated with your account, mobile notification, hard copy or posting of such notice on our Services. Syncycle's is not responsible for any automatic filtering that you or your network provider may apply to such notifications.
11. Complaints and termination
In the event of complaints relating to Syncycle and its Services, please first contact the front desk assistant for the fastest possible solution and, secondly, address the issue in writing to [email], describing the issue detailed and accurate within 7 days of the facts giving rise to the complaint. You may terminate your account , at any time, for any reason, by contacting us via email at riders@syncycle.be. We may terminate your access to the Services at any time, in our sole discretion, without cause or notice. We may terminate your account at any time, without warning, if you breach the Terms. If we terminate your account because you have breached the Terms, you will not be entitled to a refund of any fees or for any unused portion of any class packages. The following provisions will survive the termination of this agreement: Article 4 Refund Policy, Article 5 Intellectual Property Rights, Article 7 Assignment, Article 8 Limitation of Liability, Article 11 Termination, and Article 13 Governing Law.
12. Miscellaneous
If any of the provisions of these Terms shall be unlawful, void or for any other reason unenforceable, then only that provision shall be deemed null and void and this will not affect the validity and enforceability of any remaining provisions.
13. Governing law and jurisdiction
Belgian law will apply to these Terms and the courts of Brussels have exclusive jurisdiction unless public policy or imperative national law foresee otherwise.
